B & C Awnings, Inc. hereby warrant that the products supplied and installed on the above project the subject of the approved shop drawings are in accord with those drawings and specifications shown reflecting all the changes, anchors and finishes together with methods of attachment and installation approved by the Owner/Contractor or agents thereof and fulfills the requirements of such finally approved specifications. B & C Awnings, Inc. guarantee that upon being notified with 14 days to commerce to repair, provide labor, replace or cause to be repaired or replaced all work which requires repair or workmanship and/or materials together with any adjacent work which requires repair or replacement in consequence thereof and to complete the within a reasonable time period. Walking, weights, ladders, damage, abuse, and neglect will void this warranty. Excluded are water penetration, drips, leaks and any form of caulking, flashing, sealants which are the responsibility of the buyer requiring constant service and expert maintenance. Notwithstanding the previous paragraph in the event of an emergency or hazard to the safety of others, the owner or their agents must immediately phone (714) 632-3303 requesting emergency attention thereafter in the event B & C Awnings, Inc. fail to respond on a timely basis, owner or agent may undertake(if within terms of this warranty) at B & C awnings Inc will indemnify, hold harmless, and defend the owner/contractor, agents, heirs, or assignees, or pay attorney fees for any legal action associated herewith or emanating there from for the period of one year only from the date the goods or services are provided as shown below on this warranty.
On the express understanding, acceptance, and aggreement that B & C's General Liability Insurance Indemnification, Coverage, and Warranty is issued "Conditionally upon proof of Progress Payments" being rendered and received by B & C from the contractor, Owner, their heirs or assignees for the goods and services pertaining to this project.
This guarantee/warranty forms part of the terms and conditions of approved "shop drawings" is contractual usage of the products/services, guarantee/warranty referred to herein for a period of one year and one day from the date of this warranty is granted as a "Consideration" to the owner, buyer, agent, general contractor their heir of assignees from any legal action, direct or pay the attorney fees to defend B & C Awnings Inc. -- "following" the said expiration date of this one year warranty.
When branded products or finishes are specified which are the subject of another supplier or manufacturer's warranty that manufacturer's warranty takes precedence over this warranty provided by B & C Awnings Inc and B & C Awnings Inc is excluded from any liability for claims associated therewith or emanating there from for the replacement or the prefabrication or installation of products by others.
General contractor, owner, buyer, agent, their heirs, and assignees must file a "separate" claim against the manufacturer of those products or services which are the subject of any claim to the exclusion of B & C Awnings Inc.
